The problem would arise if you are observed uploading or otherwise rebroadcasting anything that goes beyond your personal use.

Seems like it's not necessarily an offense against YouTube but it is against the artists/labels so it's not quite YouTube that comes after you but the riaa/mpaa.

Assuming of course you download really something copyright like a Taylor swift song as opposed to some random clip of Hikaru Nakamura

But anyhoo Joel tenenbaum was sued not because of downloading but because of uploading. Poor guy. Well at least the guys life seems to have been back to normal since 2013, the same year Dexter ended before the revival this year.

As far as I remember, if you're in the UK and you're downloading videos/music for your own use then the worst case scenario would be a civil court trial (and that's only if the owner will raise a civil dispute). However, once you start distributing/sharing the downloaded content, then you can be charged with a criminal offence if you get caught and someone cares.

I am not a lawyer, it's just what I remember reading when I was doing my own research.

You're already downloading the music when you're watching the video.

If you just so happens to save that video it's not much of a change.

There's no way anyone could enforce anything.

It depends on the source:

  • It is always allowed to make a copy of something from a legit source for non commercial purposes. It's called "Privatkopie"

  • Its always illegal to copy from an illegal source. This is called "Raubkopie".

  • If it's not obviously clear if the source is legit or not, it is counting as legit.

In reality still no one cares. Spreading is as said highly illegal. However you are allowed to make an single unmonitized Privatkopie for someone else. For example if you want to copy your own bought movie for a friend, that's legal. Making a copy for all your friends is illegal.

Funfact: every thing/device which is capable of making copys of something is taxed in germany. Every pc, every printer, every usb stick, every smartphone is taxed. Content creators can then register their content and will receive a small amount of these taxes every year. YouTube refused to pay these taxes for a long time, that's the reason why music on YouTube was blocked in germany by GEMA (Institute for musical copyrights).

So yes, you are allowed to download music from YouTube and you probably even paid for it.

There is one exception to the Privatkopie rule: you are not allowed to circumvent any copy protection to create it. So downloading from YouTube is allowed, because they don't use any DRM as far as I am aware. So is copying audio CDs. Downloading from Netflix or ripping DVDs or Blu-rays is still illegal. Even having software or devices that are capable of doing that is illegal. Still, in reality, nobody will know or care, as long as you don't spread the copies. But if you do, they care a lot. This is why torrenting is so risky in Germany.

And? what about it? It's data on my device.

On my device I can do with that data what I please.

I may be in violation of Youtube's TOS, but Youtube's TOS aren't the law. They can feel free to ban me off their platform but that isn't of any legal consequence.

Now if I'd be going around and distributing that copyrighted material, that'd be a different matter altogether, but the copyright holders have the tools to remove their materials from YouTube knowing how it functions, and choosing to not do so.

Not really. for it to be a privatkopie, you would first need to buy and own the music, like classicaly buying a CD album and then ripping it to your computer. But since you didnt buy the music on youtube, it does not count as a privatkopie.

the thought behind privatkopien is to have a copy of your physical media in case something happens to it (like a cd/dvd beeing scratched and unreadable)

You could always claim you recovered the videos from your browser cache. There they are automatically saved in a DRM free format. 100% legal.

Edit: Reading your other comment right now. Is this no longer the case? I remeber recovering videos using ChromeCacheView for example.

It’s a grey zone you could say it’s the same as like back in the day when you recorded radio with a cassette player but you aren’t recording actually.

Also downloading isn’t really illegal the redistribution of copyrighted material is though and as most use torrent to download their stuff they also redistribute copyrighted material and for that they get in trouble for the law.

This is to settle an argument I've been having for a while.
Under Canadian law, more specifically 80(1) of the Canadian Copyright Act, |

"80 (1) Subject to subsection (2), the act of reproducing all or any substantial part of

  • (a) a musical work embodied in a sound recording,
  • (b) a performer’s performance of a musical work embodied in a sound recording, or
  • (c) a sound recording in which a musical work, or a performer’s performance of a musical work, is embodied

onto an audio recording medium for the private use of the person who makes the copy does not constitute an infringement of the copyright in the musical work, the performer’s performance or the sound recording."

there was some federal court ruling in '05, but nothing substansial came from it that I know of.
So is it legal to download mp3s from yt (using like ytmp3, aka not premium).
Is it illegal? is it against TOS? what am I liable for if I were to do this?

Thanks, and please, if possible, refer to Canadian Law, court cases, etc.
I want to have linked proof against or for my argument

If you pay for youtube then as long as your membership is in good standing you can download what ever you want, but use a third party to download is akin to napster I guess and ARRRR your a pirate matey

I can't speak for the legal side (copyright) but I can say it is against Youtube terms of services, and it isn't the same as copying a CD you own for yourself. Youtube is providing content to be streamed over the internet in exchange for a view and some form of compensation like ads or Youtube Premium. Downloading from a Youtube Downloader is not giving the views and monetary compensation for listening to the song itself. Is it enforced? Not really. Youtube will go after the downloader before they'll go after the user. Just keep in mind the artists aren't being compensated or aren't getting pushed by the Youtube algorithm to other people.

YouTube isn't free.

It's paid for by watching ads or having the subscription.

The subscription allows video downloading in the app so just get that.

Edit: Sub also let YouTube run with phone locked or with others apps open

Technically it is illegal, under the Copyright Amendment Act 2006.

As TheOneWes said, YouTube is not free. Artists get paid from either Premium subscriptions or ad revenues, so saving it to a different medium violates anti-circumvention sections of the CAA by preventing artists from receiving revenue for you listening to their music.

I’m not Australian, so I’m not sure how prolific that is or how actively local authorities prosecute such actions, but I cannot imagine anyone 1) founding out you did it and 2) caring enough to go through the effort of fining/prosecuting/jailing you for saving a few songs to listen to.

Greetings,
Before I start, I'd like to mention that all words that are bold, are defined or described at the bottom of the thread.

Long story short, I use to use an application called 'MP3 Rocket' which downloads the audio from YouTube videos and writes ID3 metadata to the MP3 file. This application was discontinued and I wanted an application which had the same features (mainly writing ID3 metadata). And since I'm a developer I thought of making my own, so I did.

Now the application I've created basically sends an HTTP request from the user's device to YouTube (which is basically like opening YouTube in your browser), which grabs the direct URL path to the video's audio file, and downloads it (only if it's available). Then it sends HTTP Requests to Genius's API to grab information about the song, like the title, artist, cover photo, published year. Then it web scrapes Genius's song lyrics page OR AZLyrics for the song's lyrics.

Now my question is, is downloading a YouTube video's audio illegal?
Because "downloading music files which are copyrighted that you do not hold the copyright to", and "burning compact discs of music that you have not purchased" are both illegal (according to this website). But it also mentions that "Downloading copyrighted songs, which have been made available by the artist for free download. In this case, the copyright holder is allowing the free distribution of their work by posting it themselves and controlling the distribution." then it's legal. Isn't uploading music to YouTube basically distributing music for free? I mean I can listen to the song a thousand times-- for free, instead of buying it.

And also I'd like to point out that nowhere in this process does my server come in and save any data. Everything is done on the client-side, and nothing is saved on the client-side either, besides the MP3 file.

Using Genius API to get song information is totally legal, and so is web scraping. Almost every website or service provider provides an API to access information from their database. And for web scraping, Google would be the biggest company scraping the web to get information, an example would be searching "What's the weather", and it scrapes weather websites and show it on their page so that you don't have to leave Google [screenshot].

Currently I'm leaning towards YouTube Premium, since I mainly use YT for learning as well.

But I wonder if YT Music suits my purposes better?

What are you expecting with downloading "legally" from YouTube? All "legally" downloaded videos/music on YouTube are really only on the Mobile/Tablet Apps and only are accessible inside the apps.

Well, that sucks. Don't mind my lack of knowledge, I've never been subscribed to any media services like this. And when I ask people around about any ways to purchase music digitally, they usually say something like YouTube or Spotify.

All the musicians I follow also have links for purchasing their works on one of these services. So I naturally assumed, that there are some tools or possibilities for actually utilising at least some parts of the music for fair use.

I can't believe, as a content creator myself, that with all that fuss over copyright and accessable resources, corporations still live us with nothing, but piracy...

Some songs (super old 2000s internet songs, Nightcore stuff, YouTuber covers, special versions, etc) can only be found on YouTube. You might be able to find them on soulseek, but chances are those files are still ripped from YouTube. Sometimes you just have to make do with the quality you can find or just do without entirely.

log in, go to search and enter an artist, filter an album through the bottom right filter. find the folder you want that has the songs u like and right click download folder (making sure you choose the songs u want only cause sometimes it has a lot more). then open the folder where the complete downloads are and move them to your music folder

I mean that's what I do and have been doing ever since I started listening to music on devices back in the day.

I even still have mp3 players and recently bought one of those Chinese bootleg headphones that have an entrance for SD card and play Mp3s right out of the card itself. Awesome.

Yeah Youtube is a great way of finding good quality mp3s nowadays, I download all sorts of stuff.

Personally when downloading from YouTube you can use apps like Jdownloader2, I also have one called VideoProcConverter, and some people use ytdlp but I personally don't like it because despite being the best YouTube downloader, it's not intuitive, I don't like using command lines and all that stuff and since I don't need the metadata, I just use some general use downloader.

YouTube now has the automated music releases free and straight into the platform, full albums you can listen and download and explore band channels divided into topics. Quality is good enough for video.
